IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE AICHARTMOTION APPLICATION.

This End User License Agreement ("EULA") is a legal agreement between you ("You", "Your" or "User") and AIChartMotion ("we," "us," "our," or "Company") for the AIChartMotion Mac application ("Licensed Application" or "App") made available through the Apple App Store.

By downloading, installing, or using the Licensed Application, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the Licensed Application.

1. ACKNOWLEDGMENT

This EULA is between You and AIChartMotion only, and not with Apple Inc. ("Apple"). AIChartMotion, not Apple, is solely responsible for the Licensed Application and its content. This EULA may not provide for usage rules for the Licensed Application that are less restrictive than the Apple Media Services Terms and Conditions ("Usage Rules"), and the Licensed Application is licensed, not sold, to You.

2. SCOPE OF LICENSE

2.1 License Grant

Subject to the terms of this EULA, AIChartMotion grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Mac devices that you own or control and as permitted by the Usage Rules.

2.2 Restrictions

You may not:

Distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time
Transfer, redistribute, or sublicense the Licensed Application
Copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application
Use the Licensed Application for any illegal or unauthorized purpose
Remove, obscure, or alter any proprietary notices on the Licensed Application

3. PURCHASE AND PAYMENT

3.1 One-Time Purchase

AIChartMotion is available as a one-time purchase through the Apple App Store. Once purchased, you have lifetime access to the application and all its features.

3.2 No Subscriptions

Unlike many applications, AIChartMotion does not use a subscription model. Your one-time purchase grants you perpetual access to the software.

3.3 Updates

Your purchase includes free updates to the Licensed Application. We may release updates that add features, fix bugs, or improve performance at our discretion.

3.4 Refunds

All purchases are processed through the Apple App Store and are subject to Apple’s refund policies. Please contact Apple Support for refund requests.

4. DATA AND PRIVACY

4.1 Local Data Processing

All CSV files you upload and process through AIChartMotion are stored and processed locally on your Mac device. We do not upload, store, or transmit your raw data to our servers or any third-party services.

4.2 AI Recommendations

When you use AI-powered chart recommendations, only metadata about your data structure (such as column names, data types, and row counts) is sent to our AI service provider. Your actual data values are never transmitted.

4.3 Privacy Policy

Your use of the Licensed Application is also governed by our Privacy Policy, available at https://aichartmotion.com/privacy.

5. USER RESPONSIBILITIES

5.1 Age Requirements

You must be at least 13 years old to use this Licensed Application. By using the App, you represent and warrant that you meet this age requirement.

5.2 Accurate Information

You are responsible for ensuring that any data you input into the Licensed Application is accurate and that you have the right to use such data.

5.3 Content Creation

You retain full ownership of any charts, visualizations, or videos you create using AIChartMotion. You are solely responsible for how you use, distribute, or monetize such content.

6. INTELLECTUAL PROPERTY

6.1 Your Content

You retain all rights to any content you create using the Licensed Application. We claim no ownership over your CSV data, charts, or exported videos.

6.2 Our Intellectual Property

The Licensed Application and all related content, features, and functionality are owned by AIChartMotion and are protected by international copyright, trademark, and other intellectual property laws.

7. THIRD-PARTY SERVICES

The Licensed Application uses OpenAI services for AI-powered chart recommendations. Your use of these features is subject to the terms and conditions of these third-party services. We are not responsible for any issues arising from third-party services.

8. DISCLAIMERS

8.1 AI-Generated Recommendations

The Licensed Application uses artificial intelligence to provide chart type recommendations and data visualization suggestions. These recommendations are for informational purposes only and should be reviewed and validated by you before creating final visualizations. We make no guarantees about the accuracy or suitability of AI-generated suggestions.

8.2 Data Visualization Accuracy

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THE ACCURACY OF ALL CHARTS AND VISUALIZATIONS CREATED WITH AICHARTMOTION. WHILE WE STRIVE TO PROVIDE ACCURATE DATA RENDERING, ERRORS MAY OCCUR. ALWAYS VERIFY YOUR OUTPUT BEFORE PUBLISHING OR DISTRIBUTING.

8.3 No Warranty

THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AICHARTMOTION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL AICHARTMOTION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE LICENSED APPLICATION.

IN NO EVENT SHALL AICHARTMOTION’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE LICENSED APPLICATION.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AIChartMotion and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to your use of the Licensed Application, content you create with the application, or violation of this EULA.

11. TERMINATION

11.1 Termination by You

You may stop using the Licensed Application at any time by deleting it from your Mac device.

11.2 Termination by Us

We may terminate or suspend your access to the Licensed Application immediately, without prior notice, if you breach any provision of this EULA.

11.3 Effect of Termination

Upon termination, all rights granted to you under this EULA will immediately cease, and you must stop all use of the Licensed Application and delete it from your devices. Your one-time purchase fee is non-refundable upon termination.

12. THIRD-PARTY ACKNOWLEDGMENTS

12.1 Apple’s Role

Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

12.2 Maintenance and Support

AIChartMotion is solely responsible for providing maintenance and support services for the Licensed Application. Apple has no obligation to provide any maintenance or support services.

12.3 Product Claims

AIChartMotion, not Apple, is responsible for addressing any claims relating to the Licensed Application, including product liability claims, claims that the Licensed Application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

12.4 Intellectual Property Claims

In the event of any third-party claim that the Licensed Application infringes that third party’s intellectual property rights, AIChartMotion, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

13. EXPORT COMPLIANCE

You may not use or export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

14. GOVERNING LAW

This EULA shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under this EULA will be brought exclusively in the courts of competent jurisdiction.

15. ENTIRE AGREEMENT

This EULA, together with our Privacy Policy (available at https://aichartmotion.com/privacy), constitutes the entire agreement between you and AIChartMotion regarding the Licensed Application and supersedes all prior agreements and understandings.

16. SEVERABILITY

If any provision of this EULA is held to be unenforceable, the remaining provisions will continue in full force and effect.

17. CHANGES TO THIS EULA

We reserve the right to modify this EULA at any time. We will notify you of any material changes by posting the new EULA on our website or through other appropriate means. Your continued use of the Licensed Application after such modifications constitutes acceptance of the updated EULA.
